Brazil court suspends Stake injunction one day after it was granted

Stake’s short window to keep operating in Brazil closed almost as soon as it opened.
On Friday, October 9, the president of the Federal Regional Court of the 3rd Region (TRF3), Luis Antonio Johonsom Di Salvo, suspended the injunction that had allowed Stake Brazil to keep offering fixed-odds betting until October 25. The suspension came one day after a São Paulo federal judge granted the injunction.
The federal government, through the Attorney General’s Office (AGU), asked for the suspension. It argued that the order favoured Stake over every other platform facing the same restrictions.
In his decision, the TRF3 president said the injunction applied the rules unequally. He also raised the risk that other operators would go to court for similar exceptions.
The suspension stays in place until the case is closed or the TRF3 presidency rules again. It does not decide whether the underlying ban is constitutional.
The original injunction was issued on October 8 by Judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court in São Paulo. Stake had asked to operate until December 2029, when its licence was due to end. The judge refused that but let it continue until October 25, under conditions covering player protection and promotional limits.
The dispute stems from Provisional Measure 1.394/2026, which President Lula announced on September 25. It ends operating authorisations for fixed-odds betting and online casino platforms, and its restrictions have been in force since October 6. Stake told the court it had invested around BRL 128 million in the Brazilian market, including a BRL 30 million licence fee.
Stake is not the only one fighting the measure. Industry associations ANJL and IBJR have asked the Supreme Federal Court (STF) to suspend it. The broadcasters’ association ABERT and more than 20 football clubs have also joined the challenges, among them Flamengo, Cruzeiro, Fluminense and São Paulo FC.
The STF has not ruled yet. Justice Luiz Fux, who is handling the cases, is reportedly expected to decide after the October 25 presidential runoff.
